Montana Agency Law offers the following Relationship types in Real Estate.

Seller Agency

Buyer Agency
Disclosed Dual Agency
Statutory Brokerage


Seller Agency: A Seller Agent is obligated to the Seller to: Act solely in the best interest of the seller while obeying promptly and efficiently all lawful instructions of the seller. Seller Agents must disclose all relevant and material information that concerns the real estate transaction which is know to the Seller Agent and not known or discoverable by the Seller unless the information is subject to confidentiality arising from a prior or existing agency relationship on the part of the Seller Agent. A Standard Exclusive Right to Sell Listing Agreement creates this type of relationship.

Buyer Agency: A Buyer Agent is obligated to the Buyer to: Act solely in the best interest of the Buyer while obeying promptly.......(see above, substituting Buyer for Seller). Buyers may chose to have an Exclusive Buyer Agency Agreement or a Non-Exclusive Buyer Agency Agreement depending upon their individual needs and desires.

Both Seller Agents and Buyer Agents are:  Obligated to safeguard the confidences of their client, exercise reasonable care, skill and diligence in pursuing the client's objectives and in complying with the terms established in any Agency Agreement. Relevant and material information to the transaction must be disclosed.  All funds must be accounted for and federal and state laws must be complied with.

Disclosed Dual Agency: This Agency relationship is created, with written consent, when an agent for the Seller also brings the Buyer to the property. The agent is equally obligated to both the Buyer and Seller and, while the above obligations remain in force. Dual Agency may prohibit the agent from advocating exclusively on behalf of either client.

Statutory Agency: In this Agency relationship, the agent is not an agent for either Buyer or Seller, but nevertheless is obligated to them to: disclosed any adverse material facts that concern the property and that are known to the Statutory Agent, except that the Statutory Agent is not required to inspect the property or verify any statements made by the Seller.
